Permits
Obtaining the required economic permits is essential for anyone aiming to start or operate a business in Curaçao.
Required Licenses
The most important licenses required are:
- Business Establishment License: Issued by the Ministry of Economic Development of Curaçao, permitting the corporation to operate on the island.
- Director’s License: Required for each managing director. There is no limit to the number of managing directors. Additionally, managing directors need a residence and work permit to work in Curaçao. This requirement applies to all expatriates, except those with a Dutch passport, who do not need a work permit.
- Foreign Exchange License: In specific cases, this license can be obtained from the Central Bank, exempting the corporation from foreign exchange controls.
Depending on the type of business, additional licenses may be required for:
- Specific Businesses: Such as licenses under the Nuisance Ordinance, and licenses for restaurants and hotels.
- Specific Activities: Such as importing merchandise, operating outside regular hours, transferring money abroad, etc.
- Personnel Matters: Such as overtime approvals, discharge permits, and health certificates.
Environmental Impact Assessment
Under the Nuisance Ordinance, activities that could negatively impact the environment must obtain a license. Applications, including an environmental impact assessment, must be submitted to the Ministry of Health, Environment, and Nature. The ministry reviews the request and may conduct a public consultation before making a decision.
